Mr. Trump, You’re Fired!

Tables have turned, Mr. Trump. Neglecting to the get the proper permits for a local real estate development project could be means for a Trump-style firing.

Just 30 minutes from downtown San Diego, you’ll find the site of the future Trump Ocean Resort Baja Mexico. When complete, the resort will consist of three 26-story towers overlooking the Pacific. “Trump Ocean Resort Baja will set the standard of premier property ownership and excellence in service for all of Northern Mexico,” according to Donald Trump.

The development was started in 2005 when the San Diego real estate market was hot. Back then, the idea was that the housing boom in San Diego would create a population prime for the picking for buyers in a Trump resort. Property across the border would be less expensive: affordable luxury. Studios are $400-420k, one bedrooms are $480-550k, and two bedrooms are $660-770. Buyers have lined up, putting 30% down to hold a unit. Well over a hundred units are already reserved.

As for the site in Baja? The project garnered criticism early on, such as Surfline’s article “New Trump Baja Resort to Be Built on Mexico’s Most Polluted Beach” which set out to warn potential buyers that 30 million gallons of sewage are dumped daily on the beach. Despite these kinds of criticisms, the development has moved forward, slowly.

However, now we’re hearing about a new hiccup. According to the San Diego Union Tribune’s article “Slow going for Trump resort“,”Tijuana officials say the developer received a land use permit in 2005, allowing 526 units to be built on the property that juts out into the Pacific Ocean at Punta Bandera. But the developer has yet to receive a construction permit from Tijuana’s Urban Development Department, the key city agency that gives the go-ahead for new projects.” With having already taken money from many buyers and the project being behind schedule, neglecting to get the proper permits could be a huge PR nightmare from Trump.

Like his contestants that sit before him in “the boardroom”, Trump is quick to point the finger to his teammate sitting beside him, Irongate. Irongate is the developer actually building the resort, while Trump is providing equity, $200M, and his name. The response to this permit fiasco from Trump’s executive assistant was, “The only thing I am at liberty to say now is that we are working with Irongate on a project there.” Meanwhile, Irongate rep says they have yet to see money from Trump and so far have just gotten his name to use. How’s this boardroom going to play out? Will the buyers pull out and say, “You’re fired!”?

    I am doing a research project on the effects of various types of tourism on the coastal environment in Northern Baja. To me it seems as if Trump's development will end of being a major eyesore to the beautiful coastline there.     Another thing is even if you win a lawsuit, it's only a judgment in your favor. Your money is long gone and at best you may get a tiny percent of it back, or nothing at all.

    kim, no offense, but why did you buy 3 units? Looking for a quick flip? You took a gamble and lost. Trump is a con artist. His casinos are broke. Trump makes his money using other people's money to make big bets. If he wins, he makes a big cut. If he loses, then you lose everything.

    I saw a big ad in the news paper that Trump is building a condo resort in Baja so I called the ph# and I got connected with sales person Rosy Torres whose father is now a Mayor of Rosarito and her father owns a Rosarito Beach hotel.She was very nice and she introduced me to Jason Grosfeld the owner of Irongate. They hiped up every thing so much and told me that how Wakiki was sold out so quickly and people had to be turned away and so on but Jason was ready to sell me a condo in Waikiki. He said that he held it for himself. Jason sold me 3 units and told me that you will never be sorry because this is Trump resort water front. Before purchasing the condo I also wanted to know who will be managing it so they had picked a very reputable company. Jason and Rosy also told me and my husband at the party that Ivanka Trump is incharge of this project and also bought a condo in the Trump tower 1. The party was very hyped up with all kinds of gifts etc. Buyers were pumped up for the next day.I feel like a big fool. I was buying the Trump condo. I also questioned about the sewage and was told that it has been corrected and ther will be their own water filteration system. I further asked that how can any body swim there but they assured me that it's all behind.
    I am absolutely sure that Mr. Trump is hungry for money and greedy that he planned this scam to make money.I am loosing over $500k. I am so crying and have been writing to all the news papers and ABC's prime Stime to let every one know BEWARE OF TRUMP DEALS. I also hope that we win this case and we all get our money back. What a scam? I have Rosy's business cards that also says Trump-Baja and every where else. How could any body know that it's only his name being used. At least I didn't.My sales agent didn't even inform me about the project going under until I received the papers from the South Land Title company that they have taken out all the deposit from the buyers there is no money in the account there fore they have resigned. I hope we all take him to court and get our money back.

    I feel like an idiot. The first news I heard about this was on the radio, November 1, 2008. After hooking on the net and reading everything else from other investors, I feel totally raped. What can be done?

    The probability that Trump Baja will ever be built is slim to none. The developers pulled the wool over all the purchasers’ eyes by selling the product in San Diego to Americans only. If they would have done this sale in Mexico to Mexicans it would have been totally illegal. To start off they did not even have building permits to build the resort and it is questionable that they even have the permits today. They supposedly did $160 Million in sales with 30% deposit monies that is $48 Million in cash collected. They say they DO NOT have any money, what happened to the $48 Million? I do not care that they cannot get financing to build the project; they should have already had the funds to build before taking our money. Didn’t Trump/ Irongate just get done selling $800 Million in Hawaii in one day, where did all the money go? How many of you have purchased and have asked for a refund and have been told they will not refund but offer to sweeten the deal? This project is a runaway train and they are about to crash with our money, what are we going to do about it? We all need to get together and start a class action lawsuit, against first off The Trump Organization because lets all face it without the Trump name we would have never purchased at the resort. Irongate also included in the suit because they are the ones behind this fiasco. A lien can be put on all of PB Impulsores assets; they are the company on the contracts but claim to not being owners of the property where the resort was to be built. The property apparently is in a trust and according to Irongate it cannot be touched. In Mexico there needs to be proof that the Trust and PB Implusores are the same company and that can be proven. They definitely have created a very sophisticated assortment of companies in order to protect themselves from any legal problems but they are not infallible there are ways to get at them. We all need to ban together and bring this public, TV, Internet, start a website, Youtube and any other means possible in order to not let Trump and Irongate get away with our hard earned dollars.

    I am also disappointed on how slowly construction of the project is going but I still think we should give the developer the benefit of the doubt. We are in the mist of one of the worst financial meltdowns in modern history. This no doubt has made obtaining financing more difficult for the developer. But like all of you I am concerned about the wisdom of my investment in this project. I would like to form a dialog with other investors to share experiences and keep one another informed.     I too would like to get my money back. I deposited 30% and was told that I would have the keys by the end of 2008. They lied to all of us. They are holding $165,000 of my money and I want it back. If any other buyers out there want to get together and file a lawsuit, maybe we can get something going and have them return our deposits.     I would like to hear from you and other owners of the Trump Ocean towers Baja. We have had the very same experience you have had Rafael. I have been doing some research on other Trump Tower projects and see that he is having trouble in several states for the same reasons we have been promised a condo in the Baja with a key in our hand this autumn 2008. He is being sued for much the same problem everywhere else. Our question is who has the money (our deposit) and who is collecting interest on it?? The point of contact we have is Matias Susel located at the site in Baja. After many calls around the country to other people who have been swindled with deposits with open-ended contracts we telephoned Matias. He tells us our money is being held in Southland bank in San Diego and "no one is collecting interest on it!Also, contrary to what the sales people from S&P Tower said when selling Tower II, Tower I had never sold out!! They are all lying!Rafael, I hope you get this because if we can get some other buyers together we were lied to by everyone involved. We need our money back. I have spoken with an attorney here in California and am in the process of speaking to people in other parts of the Country who have had this problem with the "Trump" name on condos. Together we must press them to return our money now before they have to give us interest as well. Mathis said that it will be 2009 or 2010 before they start to build, if then, because the builder does not have a loan to build. It is BUYER BEWARE

    BUYER BEWARE...I purchased with Trump Baja and was told there would be a completion date of December 2008, it was in the contract. Seven months into the purchase I was sent a HUD report and told there would be a 3rd quarter 2009 completion date because the HUD report released Trump Baja from any obligation to complete by December 2008. Included in that HUD report was the option to cancel the contact within 2 years of signing the contract. I have tried to cancel according to the terms (HUD Document) of the contract but Trump Baja/ Irongate/ S&P Properties has not respected the terms of the agreement and refuse to refund my deposit.

    Through many hours of research I have found many irregularities involved in the Trump Baja Resort investment. NUMBER ONE just how safe is the area? After doing a Google search using the key words Baja robberies and murders which to my surprise turned up 124,000 results.
    BUYER BEWARE…I can almost guarantee Donald Trump has never visited the build site and if this is true I think we all know the reason why, he understands the risk factor. Kidnappings are at an all time high in the Tijuana area. Are the developers thinking about the safety of the Trump Baja Owners or are they just trying to make a quick buck. With the high risk factor how many high end renters will be attracted to the resort, I would assume many investors purchased with the idea of a rental return, under the current conditions that is just a pie in the sky.

    Another major concern is the raw sewage treatment plant that is located just behind the resort, to date there is an awful odor that comes from that plant. Trump/Irongate has assured me that the smell will go away, they cannot explain how or why it will go away but they assure me the smell will not be there upon completion . What if it doesn’t , what will that 200 million dollar resort be worth? Did Trump/ Irongate really do their homework before purchasing this property? I am embarrassed and feel like a fool but I did not visit the site before purchase and took the sales representative's word that the location was pristine and without problems. BUYER BEWARE…that is a problem. Google Trump Baja raw sewage there are currently 817 items and the list is growing quickly.

    When I purchased the Trump Baja resort I did not purchase a condominium unit I purchased the Trump name for which at that time I thought stood for first class developments not deceit. It seems like I was wrong and because of this I am committed to getting the word out BUYER BEWARE.

    Sounds like too much trouble and potential issues that would lead to big a headache. I'm going to Palm Springs!

    interesting to know-I wonder what the numbers are and if they are sustainable-
    the mexican government changed some of their laws about purchasing property. i don't know the specifics about land but several years ago the only way to purchase an existing structure was cash-financing wasn't an option-the salesperson in ensenada (unlicensed by the way-re licensure is not a requirement)indicated the mexican authorities now accept financing from us banks and there are existing financial institutions in San Diego currently handling this type of transaction
    my understanding with the trump project is that they would provide an onsite sewage treatment plant for their waste but that says nothing about the existing problem
    it would be nice if they would build with the capacity to handle the rest/that may be a deal they strike in the permitting process
    another caveat-mexico has had agreements with the U.S. about water rights on the rio grande river that are tied to sewage and industrial waste discharge (limiting them) for a number of years and enforcement has been difficult-in essence we have alotted more and more water usage tied to pollution compliance and while we've not shut them down on the water usage, they haven't met all the compliance requirements. Of course, we can only push so much as they have natural water rights to the rio along the border. This is a federal thing and I wonder if there are similar agreements in place for the Colorado watershed. Does a significant amount of water reach them? Of course that still wouldn't impact the pacific coast but it's a model of U.S. and Mexican cooperation on pollution issues that developers and U.S. interests may be looking to.
    $500K may be more palatable if some of these things can be rectified and of course an infusion of money would help the local economy. The problem would be in changing the social climate that has many folks hesitant to take a trip south of the border. Money may help in that regard as well.
    i'd still buy a gulf coast condo or a mountain retreat but someone who has a spare $500K, really likes baja and has the patience to wait might not go too wrong-if there's a marina tied to the project they may get the developer to agree to sweeten the deal by throwing in a boatslip or 2 years condo association fees etc. You can always negotiate-just be willing to walk away and you'll probably get what you want
    as far as not wanting to give trump money because you don't like his ethics? there are ethical developers out there and checking public records for lawsuits, fines, etc. can help determine if you've got one-I'd just be hesitant to beleive every bad thing as well as every good thing you read about someone-looks can be decieving and when a lot of money is involved lawsuits can be made out of minor or nonexistent infractions.

    I think there is a tradition in some families here in SoCal that vacation in Baja. I knew some of these families growing up in Newport Beach.

    Also, as a US citizen, I don't think you can buy land across the border... so buying a luxury condo from Trump would help someone cross that barrier.

    I still agree that $500k is much too much to spend for a condo in Baja. And, there are definite ecological problems... aside from the sewage being dumped there.

    Thanks-I was a real estate agent and property manager in Florida until recently. There I saw most of our investment money coming from the big markets in driving distance (Birmingham and Atlanta.) So I'd agree that the bet was at least partially wagered on the drive to crowd. The draw Baja doesn't have that we did was warmer water than the Atlantic, and significant and well established generational tradition of vacationing on the gulf coast.
    I agree it's stretching the term beyond it's true definition to call the properties in the Gulf state areas comps that someone from the western market could use in assessing the value of the baja project but the product(highrise beach condo)and the buyer demographic does have some key similarities. Primarily, the price tag. If I have $500,000 to spend on a vacation property I intend to use 1-2 times a year and rent the rest of the time, where am I going to put that money? Or how much does proximity count to the investor?
    There is a definite appeal to an in the sand condo but is a beach vacation in Baja different enough from a beach vacation anywhere else along the California coast to have large enough numbers traveling south? I don't know. Would mountain staters fall prey to Mexico's lure? Folks from Canada and Oregon? International tourists who have been the targets of direct marketing? The only other "hope" for the project would be prestige or novelty buyers who want to collect a baja property.
    One final note and I'll call it a close, several years ago in an environmental publication there was mention of a proposed plan by the Mexican government to provide funding and permitting support for a chain of marinas and resorts along the baja coast to Cabo. The Trump project seems to fit into that plan although I beleive there was some strenuous protest to the plan noting the unique ecosystem.
    It will be interesting to watch. It could possibly turn into a "I could have bought it back then for less." Still 1/2 a million for two bedrooms and a view is a big investment.
  • Interesting perspective, Maureen. I think the idea was that southern CA would be attracted to how close the Baja project would be (a quick drive vs. a flight to Texas or Florida). With that said, I don't see the properties that comparable.

    I, too, don't see the property being successful, unless, like you say, they get some celebrity party goers get in on the action which would help attract the masses (but maybe not the masses with the cash to back it up).

    more fun-yes i have another opinion. I looked at this-even called a salesperson in Ensenada about the Baja market and did an extensive search of listings. The prices are comparable to the Panhandle of Florida and Alabama and Louisiana gulffront are lower. I don't know about Corpus Christi Texas area but think they are similar to LA and AL. Hilton Head, is about 20% higher but smaller Atlantic resort areas compare well. All things considered, I couldn't get a hook on how they made sense when comparable properties are available on the us side. Even OB has better deals if not quite so quiet. They might make sense from an investment angle if they would cash flow with rentals but I don't think the tourists are there to support the $20-$40K a rental property would have to make to make the asking price worthwhile. In 5 years? As far as the reservations go-the 30% is most likely a 10-20% refundable deposit held in escrow and a letter of guarantee from a financial institution for the remainder with no locked in rate. This is fairly standard and doesn't represent any hijinks by trump or the developer, a res is not a contract and is fully cancellable by either party. However, with only 100 reservations it's unlikely that the developer or trump like their chances and are probably putting the project on hold until they can get 50-80% reservations. Or I could be wrong and Paris and friends could buy the thing up for fun in the so. of the border sun.
  • I think in theory Baja condo projects are a good idea... but I'm not sure you could persuade me into ever buying one. Although, it would be nice boost to Baja's economy.
  • Interesting project but I agree. Trump's been bailed out more often than the President's various oil businesses. Several projects are underway in nearby Baja and many are beset with infrastructure problems- water, sewer, streets... There will be exciting opportunities for Mexicans and Americans.

    I wish the reall Trump story could be told and learned by the masses! In Atlantic City Trump 3x defaulted on billions in junk bonds leaving investors holding the bag. His company is notorious for driving insane deals and then not fulfilling his part. But they still come and subject themselves to the Don. ANything remotely related to Trump is a negative for me. From his crappy colognes to his "designer line of fashion" just say NO!
